基于医疗卫生体制改革视角的医患关系研究
摘 要 中国医疗卫生体制及其改革过程对医患关系具有深刻的影响作用。从医疗卫生体制改革历史进程的视角，深入分析和研究医患关系与体制之关系，是从制度层面的角度认识和解决医患关系问题。医疗卫生体制本身内置有关构建和谐医患关系的设计，应当是体制建构的应有之义；计划经济背景下医疗卫生体制所造就的医患关系形态有其特定的历史性根据；体制演进所导致的公益性缺失带来的医患关系种种问题的出现，从另一个角度说明体制与医患关系两者关系的密不可分。合理的医疗卫生体制对重新建构和谐的医患关系具有重要作用。

Research on Doctor - Patient Relationship Based on
the Perspective of Health System Reform

Abstract China"s medical and health system and its reform process have a profound impact on the relationship between doctors and patients. From the perspective of the historical process of medical and health system reform， in-depth analysis and study of the relationship between doctor-patient relationship and system is to understand and solve the doctor-patient relationship from institutional perspective. The design of the medical and health system itself， which is related to the construction of a harmonious relationship between doctors and patients， should be the proper meaning of the system construction. The form of the doctor-patient relationship created by the medical and health system under the planned economy has its own historic basis. The emergence of the doctor-patient relationship brought about by the public welfare deficit， illustrates from another angle that the relationship between the system and the doctor-patient relationship is inextricably linked. Reasonable health care system to reconstruct a harmonious relationship between doctors and patients has an important role.

伴隨中国社会的进步，中国医疗卫生体制正在经历一个不断完善和不断趋于合理的改革过程，这个过程对医患关系具有不可小视的影响作用。如果良善的医疗卫生制度和由此形成的相关环境缺失，则从根本上破坏了患者权利实现的土壤，进而会对医患关系产生十分不利的影响，所以科学、完善的医疗卫生体制是实现和谐医患关系的重要保障。
1 建构和谐医患关系是医疗卫生体制的应有之义
长期以来医疗卫生体制改革是一个笼统的概念，无论官方还是学界很少有专门性的阐释，虽然这种解释十分必要。以至于尽管人们都知道医疗卫生体制改革十分重要，几乎达到耳熟能详的地步，但是对什么是医疗卫生体制并不熟悉。在梳理我国医疗卫生体制改革脉络的基础上，我们可以对医疗卫生体制这一概念的内涵作大致的界定：医疗卫生体制是指为了实现“人人享有医疗保健”的目标，在政府主导下建立的关于公共卫生服务、医疗资源分配、医疗服务与医院运营等方面的各项制度的总称，具体包括医疗保障、公共卫生等制度。医疗卫生体制改革就是优化各项制度，实现医疗卫生服务行业的公平与效率，主要应该做的工作是通过提升医疗服务的可及性、提高医疗工作的质量与水平，保障每一个公民享有基本医疗保障权利，获得优质的医疗卫生服务。①一个国家健全的医疗卫生体制，是公民充分享有医疗权、建构和谐医患关系的根本保障。
改革开放政策自从20世纪80年代实施以来，中国社会进入转型时期，此时医疗卫生体制改革尚处在摸索阶段，受到社会转型的深刻影响，朝着什么方向进行改革，成了摆在社会面前的难题，政府与市场的关系与作用也一度不够明晰，甚至出现了所谓“双失灵”的情况。这是导致医患关系开始出现问题的大环境因素。医患关系正是在这个阶段，开始呈现出前所未有的紧张状态，以至于整个中国社会都在问为什么多少年来十分和谐的医患关系到底怎么了。医患关系所表现出的不和谐状态，既包括相对缓和的医患双方总体上的关系冷淡、双方信任感缺失、不能站在对方立场上相互理解、甚至缺乏必要的尊重；也包括尖锐的医患冲突与纠纷的时有发生。前者体现了医患关系的“亚健康”状态，本身也是一种病态的存在，而且为演化为医患冲突埋下祸根；后者的危害则是直接的和对医患关系摧毁性的伤害乃至破坏。尽管政府、社会、医院等各个方面做了大量工作，但是建立起和谐的医患关系，任重而道远，破解医患关系困局依然是当前面临的一个重要任务。
